Question about a sealed record and firearm rights?

As a juvenile, I was charged with assault in the 4th degree. It was a misdemeanor charge. I plead guilty, and a part of the plea bargain told me that I gave up my rights to possess a firearm for life, unless I decide to take it back to court. I was 13 at the time of the charge, and I will be turning 23 years old this year.

I had my record expunged.

I went to purchase a pistol, and I explained to the gun store that I lost my right to own a firearm, and that I have an expunged record, and they said it would come up on the background report if I’m ineligible. Well, nothing came back, and I got my pistol.

I even applied for my CPL (Concealed Pistol License) and explained the same thing to the police department. They said if it’s expunged, then I don’t have a record. They did the fingerprint check, and nothing came up at all. They explained that even though I had my right taken away, that considering how my record is expunged, they can’t access the info, and they granted me my license.

I even called the FBI, and they told me the same story.

Basically, my question is, did having my juvenile record expunged restore my rights? No one gave me a clear answer. They just said that I’m NOT ineligible to own a pistol or a license to carry one.

I had my record expunged.

I even called the FBI, and they told me the same story.

Concealed pistol licenses?

When you have a concealed pistol license issued by the state you live in, it is often honored for other states as well. My question is, if you have a concealed pistol license issued by the state, can you carry it on Federal property if in the same state? For example, the U.S. Post Office is considered Federal property. Would they honor your license as long as it’s still technically in the state?

Mayor makes gun law that violates state law?

ok, so how is this? the mayor of Seattle made a gun law that clearly violates state law. take a look:

Seattle Mayor Greg Nickels, in a sweeping attempt to respond to a rarely occurring problem, has issued an executive order banning firearms from all Seattle city facilities, including parks, Seattle Center, and community centers. The order includes holders of concealed pistol licenses (CPLs).

Mayor Nickels apparently has a reading comprehension problem. The statute, RCW 9.41.300, is clear as can be:

(2) Cities, towns, counties, and other municipalities may enact laws and ordinances:

. . .

(b) Restricting the possession of firearms in any stadium or convention center, operated by a city, town, county, or other municipality, except that such restrictions shall not apply to:

(i) Any pistol in the possession of a person licensed under RCW 9.41.070 or exempt from the licensing requirement by RCW 9.41.060; or

That last part, refering to 9.41.070, is the concealed pistol license section.

But the Mayor thinks that his reading of a confused decision by Justice Fairhurst overrides plain language. I guess I should not be too surprised: in our postmodern world words can only mean what nobody thinks they mean.

So how would something like this hold up in court?

My State (Washington) preempts ALL firearm laws, and does not allow any city or county to create any ordinance that is more restrictive than what is already restricted in State Law.

In a nutshell, the places that are restricted are court facilities (although they must provide the citizen with a lock box, or individual that will store your weapon), liquor establishments that are off limits to those under 21, school facilities (with certain exceptions), law enforcement facilities, and places where inmates are housed.

There is also a law that allows cities and counties the ability to restrict firearms in stadiums and convention centers, but strictly exempts those who possess a Concealed Pistol License – although you do not *have* to conceal it. You can carry it openly or concealed.

This brings me to my question,

One city in particular has created a specific ordinance that restricts the carry of firearms in their city park. It’s listed on their municipal code, and this ordinance is not in compliance with state law.

Who does one complain to, to get this removed?
