I know for sure you can have a unloaded shotgun in your truck because I always carry one in my truck and Im 16 but I do not keep it loaded I was just pulled over last night for speeding and they searched my vehicle and all he did was ran the serial number to make sure it wasn’t stolen and he gave me a ticket for speeding and gave me back my gun and said have a nice night.
Well truth be told anyone with enough guts to follow through with the lawsuits can carry an unregistered firearm openly anytime they like you just have to be willing to go all the way to the supreme court to get your ruling.
But in the end the second conveys that right "uninfringed"
Yes you can. The Texas legislature recently approved it.
2007 AMENDMENTS TO
CONCEALED HANDGUN STATUTE
AND
RELATED STATUTES*
80TH LEGISLATIVE SESSION
H.B. 1815 Traveling & Unlicensed Carry
• Allows the unlicensed carrying of a concealed handgun inside or directly en route to the person’s motor vehicle.
Amends Section 46.02, Penal Code to add Subsection (a-1) and (a-2):
(a) A person commits an offense if the person intentionally, knowingly, or recklessly carries on or about his or her person a handgun, illegal knife or club if the person is not: (1) on the person’s own premises or premises under the person’s control; or
(2) inside of or directly en route to a motor vehicle that is owned by the person or under the person’s control.
(a-1) A person commits an offense if the person intentionally, knowingly, or recklessly carries on or about his or her person a handgun in a motor vehicle that is owned by the person or under the person’s control at any time in which: (1) the handgun is in plain view; or (2) the person is:
(A) engaged in criminal activity, other than a Class C misdemeanor that is a violation of a law or ordinance regulating traffic:
(B) prohibited by law from possessing a firearm; or
(C) a member of a criminal street gang, as defined by Section 71.01.
(a-2) For purposes of this section, “premises” includes real property and a recreational vehicle that is being used as living quarters, regardless of whether that use is temporary or permanent. In this subsection, “recreational vehicle” means a motor vehicle primarily designed as temporary living quarters or a vehicle that contains temporary living quarters and is designed to be towed by a motor vehicle. The term includes a travel trailer, camping trailer, truck camper, motor home, and horse trailer with living quarters.
Amends Section 46.15(b): In pertinent part:
(b) Section 46.02 does not apply to a person who:
(2) is traveling:
(3) is engaging in lawful hunting, fishing, or other sporting activity on the immediate premises where the activity is conducted, or is en route between the premises and the actor’s residence or motor vehicle, if the weapon is a type commonly used in the activity….
Repeals Section 46.15(h), Penal Code (defining ‘recreational vehicle’ as a residence) and Section 46.15(i) (the "traveling presumption").
It can be loaded (that is the big difference with other states where the gun has to be unloaded and the rounds have to be separate).
Unlike a shotgun it cannot be visible. The law only allows carry concealed to and from residence unless of course you have a CCW permit/license.
For safety sake it is recommended you keep the weapon in a cable or bolted attached safe in the vehicle when you are not there.
