I have a concealed carry license and have had it for over 10 years now. Today a friend and I were detained by the cops. When I told them that I was carrying a registered and legal firearm and showed them my concealed carry permit, one of them said that if my passenger was a convicted felon that BOTH he and I would be going to jail! Is this true? I’ve read the law over and over again, and nowhere does I can’t find it anywhere in the Oklahoma Self Defense Act manual.

Ok, the issue in question is in regards to the legal carrying of concealed weapons. I possess a valid concealed weapons license issued by the state BCI. My concern is with an ordinance that is in effect for the city in which I live. The ordinance states that: "No person shall knowingly possess a firearm on his person or shall possess a firearm within his control on private property without the consent of the owner of the property or the person in charge thereof."

The problem is that there is a specific provision in state century code that states: "62.1-01-03. Limitation on authority of political subdivision regarding firearms. No political subdivision, including home rule cities or counties, may enact any ordinance relating to the purchase, sale, ownership, transfer of ownership, registration, or licensure of firearms and ammunition which is more restrictive than state law. All such ordinances are void."

Further, the state defines the locations where carrying of a concealed weapon is prohibited, these sites being: "Liquor establishments, gaming sites, any public gathering, including: sporting events, schools or school functions, churches or church functions, political rallies or functions, musical concerts, publicly owned or operated buildings, and publicly owned parks where hunting is not allowed".

I’m wondering what the first point of procedure should be, or who I should contact regarding the validity of this city ordinance. Should I contact a private lawyer, court system, etc? Thanks for your help.

The conflict is within the "Licensure" as mentioned in the state century code. The state has issued me a license in which I may carry a concealed weapon in all locations not provisioned against/prohibited by the state. If "Licensure" wasn’t specifically noted in the code, I would agree with you completely.
An additional note.

The city ordinance I mentioned is sub section B of a parent section. Section A states: (a) No person shall knowingly possess a sidearm on his person or shall possess a sidearm within his control on private property unless:" Sub-section A.(1) "He is allowed to do so under a permit issued pursuant to state law;"

That most gun control is design to incrementally chip away at gun ownership freedoms by criminalizing harmless gun ownership activites rather than deter harmful criminal actions.

Example, the felony ban on taking a firearm within 1,000 yards of a school. If you take a protractor and draw a 1,000 yard radius around each school on a map, you will find the circles overlapping and virtually shutting off all major throughfares in a city to those who would harmlessly transport their firearms to a range or from a store to their homes.

Filling out a form incorrectly when purchasing a firearms. If you botch the address (put St. instead of Street, for example), technically the feds can charge you with a felony offense.

Exposing a concealed weapon inadvetently. If you have CHL (Concealed Handgun License) in a state and the wind blows your overgarment up to reveal the grib of your sidearm, you are guilty of a crime. (Would not a minor fine be more appropriate?)

If some angry girlfriend issues a protective warrant against you, you are suddenly a felon for being in possession of a firearm, even though you were not present in the proceedings to argue your case, not givin any opportunity to transfer your firearms out of your possession. (Are we not innocent until proven guilty? Should not only guilty parties be denied their freedoms?)

Domestic Gun Ban. If you were ever convicted of a "misdemeanor" offense of family violence, you incur a "lifetime" ban from owning firearms, and if any are in your custody at the time of the conviction, you are automatically considered a felon. (Since when did misdemeanor offenses eliminate one of the freedoms in the Bill of Rights? Would banning someone from voting for getting into a misdemeanor scuffle from a political argument be tantamount to the same? Is not the Democrats’ move to grant prior felons the right to vote a contrast to denying those with misdemeanor offense the right to self defense?).

We are incrementally losing our freedoms to legislators who continue to grow their own power.

I say gun control is more about population control than fighting crime.

No, the suggestion to join the NRA is not wise. The NRA has collaborated too many times with the anti-Gun folks in Congress. Maybe joining the GOA (Gunowners of America) works.

ok, so how is this? the mayor of Seattle made a gun law that clearly violates state law. take a look:

Seattle Mayor Greg Nickels, in a sweeping attempt to respond to a rarely occurring problem, has issued an executive order banning firearms from all Seattle city facilities, including parks, Seattle Center, and community centers. The order includes holders of concealed pistol licenses (CPLs).

Mayor Nickels apparently has a reading comprehension problem. The statute, RCW 9.41.300, is clear as can be:

(2) Cities, towns, counties, and other municipalities may enact laws and ordinances:

. . .

(b) Restricting the possession of firearms in any stadium or convention center, operated by a city, town, county, or other municipality, except that such restrictions shall not apply to:

(i) Any pistol in the possession of a person licensed under RCW 9.41.070 or exempt from the licensing requirement by RCW 9.41.060; or

That last part, refering to 9.41.070, is the concealed pistol license section.

But the Mayor thinks that his reading of a confused decision by Justice Fairhurst overrides plain language. I guess I should not be too surprised: in our postmodern world words can only mean what nobody thinks they mean.

So how would something like this hold up in court?

I am a private security guard and I am only 20 years old. I know I cannot legally get my concealed weapons license yet, but I want to know, since i’m over 18 can I carry a gun for my job? I know there are certain licenses you need to obtain, but if I do that, will I be able to carry a firearm, it’s not concealed or anything if it’s holstered. I know you can buy and carry a firearm openly if you’re over 18, but I don’t know about private security. Thanks.
***I noticed many of you said you cannot own one in the United States if you are under 21. That is false. You can buy a firearm privately at age 18 and carry a gun at age 18, however you cannot buy one from a licenses seller until 21. That’s not what i’m asking anyway.

Will police treat a CCW holder differently (better or worse) than others?

I am just wondering. It seems better to know that a citizen has had firearm training and AT least been vetted to some extent (even in a shall issue state).

If someone has a CCW, they’re at least under no federal or state firearm disability and responsible enough to get a license.

Personally I’m a socialist and hate both liberal & conservative politicians.

But even I can see that they’re a mixed bag on this issue.

When he was governor of California, conservative icon Ronald Reagan signed the law forbidding open carry of firearms by civilians in urban areas.

However, even under today’s Democratic-majority legislature & centrist Republican governor, it is legal for civilians to open carry in California unincorporated areas where the local county has no laws forbidding it, including to and from your campsite when wilderness camping.

In Florida, which unlike California has an okay arrangement to license CONCEALED carry, ALL open carry is forbidden unless you are on private property, actually in the process of practicing on a legal range, or in the process of hunting, fishing or camping.
Vermont, with former governors like Howard Dean, full health insurance and a liberal reputation, requires no license whatsoever for concealed carry -If you can own it legally, you can carry it concealed, whether you are a resident or not. Few restrictions on open carry exist, and the right to BEAR arms is specified in both the state constitution and in statute in no uncertain terms.

The best concealed carry law in the U.S., Alaska’s, was written by a liberal state legislator. While, like in Vermont, a license is not required, Alaska WILL issue you one in case you travel, so that you can exercise the right in states that have reciprocal arrangements with Alaska.

So with all of these MIXED aspects of liberals vs. conservatives on gun laws, why is there an automatic assumption in the firearms community that liberals and Democrats are worse on our firearms rights than conservatives and Republicans?
