			<content:encoded><![CDATA[<p>As a juvenile, I was charged with assault in the 4th degree. It was a misdemeanor charge. I plead guilty, and a part of the plea bargain told me that I gave up my rights to possess a firearm for life, unless I decide to take it back to court. I was 13 at the time of the charge, and I will be turning 23 years old this year.</p>
<p>I had my record expunged.</p>
<p>I went to purchase a pistol, and I explained to the gun store that I lost my right to own a firearm, and that I have an expunged record, and they said it would come up on the background report if I&#8217;m ineligible. Well, nothing came back, and I got my pistol.</p>
<p>I even applied for my CPL (Concealed Pistol License) and explained the same thing to the police department. They said if it&#8217;s expunged, then I don&#8217;t have a record. They did the fingerprint check, and nothing came up at all. They explained that even though I had my right taken away, that considering how my record is expunged, they can&#8217;t access the info, and they granted me my license.</p>
<p>I even called the FBI, and they told me the same story.</p>
<p>Basically, my question is, did having my juvenile record expunged restore my rights? No one gave me a clear answer. They just said that I&#8217;m NOT ineligible to own a pistol or a license to carry one.

<p>Are you always this stupid, or are you making a special exception today? Maybe you just flunked out of school because you have no reading comprehension. I don&#8217;t know, and you probably don&#8217;t either, judging by how you type and the nonsense you spew out.</p>

My girlfriend wants to get a Carrying Concealed Weapon License (CCW) state of Florida. Is this possible? I know that I cant get a license, but can she have a firearm in the house without me getting into any trouble? Her rights should not be removed because she lives with me right? I shouldnt get in trouble because she has a firearm in the house for protection right? If someone breaks in the home and I fire the weapon in self defense of myself and our family will i get in trouble? </p>

So what your saying, is that if we are asleep, and if me and my child are in the house and the wife is not home, and someone breaks in, i must sit there and take a chance on whatever happens? I cannot fire the weapon in self defense of me and my child because of my record? So if they raise a weapon at me and fire, i cant return fire?<br />
Paul, we want a weapon in the house for protection in the house only. Does she need a CCW for that, or is it another license, or do you even need a license? Can she just buy a gun for home protection? Does it matter if its a handgun or rifle? Preferably a handgun for ease of use. She doesnt want to carry the gun on her at all. Where we live we would feel more safer with a gun in the home locked in a gun safe.<br />
I think its really dumb that if your felony is not a violent crime you cant get a weapon, what does credit card fraud have to do with a gun? My sexual assault charge was reduced to a misdemeanor so its not a felony

			<content:encoded><![CDATA[<p>My liberal government professor was really affraid today because in our State of Texas, legislation was purposed to allow students conceal carry firearms. She failed to mention that you still need a license and made it sound like shootings would become more common. Lets just think about this and use common sense. This legislation doesn&#8217;t change the fact that if you shoot someone you will go to prison for a very long time (30 years?) and if you kill someone (collateral damage) in a shoot out even if your shoot at a bad guy and hit someone else on accident; you can face the death penalty or prison. Now with this being said is it a bad idea to let students with concealed carry licenses bring their weapons to college classes. I&#8217;d love the opportunity because it seems like gun free zones are just asking for trouble  because there really isn&#8217;t a lot stopping someone from bringing a gun into those zones with many unarmed people who follow the law.

			<content:encoded><![CDATA[<p>I live in MA and have a LTC (Licence to Carry) if you dont know what that is the name basically sums it up, its like the CCW where I can carry concealed.  I already asked a question like this and no one could answer it so I&#8217;m going to reword it, and not really asking for an answer now just this is more of a question now on what I should do.</p>
<p>I plan on taking a trip to Boston and am going to go to some of the Museums and probably the aquarium.  I&#8217;m going to be spending a few days up there and it gets pretty shady at night.  I was contemplating contacting those places specifcally and stating that I have the LTC and what to do when I go to visit (assuming once they know I would check in with secutiry there and hand it over locked up until I leave) but then its no longer under my direct control), however they wouldnt know anyway if its concealed&#8230; however if they have checkpoints (aka metal detectors or what not) they would ultimately find out.</p>
<p>*For all the people that say Boston is Anti-Gun (its MA) so it has the same laws as every other place in MA and nothing changes.</p>
<p>I know if I send an email to these places the people reading it will more then likely be like wtf, but I feel thats the best way, I&#8217;ve read the MA firearm laws over and over and it doesnt specifically state anything about such places other then obviously I can&#8217;t carry in a Governent building, school, any place that can house 2500+ people </p>
<p>If anyone feels like going the extra mile to reseaarch the MA laws on this and can actually find me a better answer to my own question that would be great, but instead general suggestions (other then leave it at home) would be greatly appeciated.<br />

Is that true? If so, in which states do people NOT need to pass a background check to buy at a dealership? Or does other firearms legislation (1934 and 1968, et al) bypass this by making Federal Firearms licenses mandatory and, therefore, enabling back-door blanket background check requirements in all states? Such confusion. x_x

<p>Vermont State Rep. Fred Maslack has read the Second Amendment to the U.S. Constitution, as well as Vermont &#8216;s own Constitution very carefully, and his strict interpretation of these documents is popping some eyeballs in New England and elsewhere.</p>
<p>Maslack recently proposed a bill to register &quot;non-gun-owners&quot; and require them to pay a 0 fee to the state. Thus Vermont would become the first state to require a permit for the luxury of going about unarmed and assess a fee of 0 for the privilege of not owning a gun Maslack read the &quot;militia&quot; phrase of the Second Amendment as not only affirming the right of the individual citizen to bear arms, but as a clear mandate to do so.</p>
<p>He believes that universal gun ownership was advocated by the Framers of the Constitution as an antidote to a &quot;monopoly of force&quot; by the government as well as criminals</p>
<p>Vermont &#8216;s constitution states explicitly that &quot;the people have a right to bear arms for the defense of themselves and the State&quot; and those persons who are &quot;conscientiously scrupulous of bearing arms&quot; shall be required to &quot;pay such equivalent.&quot; Clearly, says Maslack, Vermonters have a constitutional obligation to arm themselves, so that they are capable of responding to &quot;any situation that may arise.&quot;</p>
<p>Under the bill, adults who choose not to own a firearm would be required to register their name, address, Social Security Number, and driver&#8217;s license number with the state.</p>
<p>&quot;There is a legitimate government interest in knowing who is not prepared to defend the state should they be asked to do so,&quot; Maslack says Vermont already boasts a high rate of gun ownership along with the least restrictive laws of any state. It&#8217;s currently the only state that allows a citizen to carry a concealed firearm without a permit.</p>
<p>This combination of plenty of guns and few laws regulating them has resulted in a crime rate<br />
that is the third lowest in the nation</p>
<p>&quot;America is at that awkward stage.<br />
It&#8217;s too late to work within the system, but too early to shoot the b@stards.&quot;</p>
<p>This makes sense!<br />
There is no reason why gun owners should have to pay taxes to support police protection for people not wanting to own guns.Let them contribute their fair share and pay their own way.</p>

I have paid for my conceal carry license and bought this nice 0 leather conceal carry jacket and now have the money to buy the smith&amp;wesson bodyguard .38 special revolver that I feel fulfills my needs in a conceal carry firearm, especially in size and weight. Well, now that I have the opportunity to finally get it, I&#8217;m wondering if I should get the Taurus ultralite .44 magnum instead (which I also really like) for my open carry gun while I hunt in grizzly bear inhabited forests, and could also use it for home defense with .44 specials. I love both these guns and intend on owning both eventually. I feel like I have more chances into running into wolves, cougars, or grizzly&#8217;s while hunting with my 30-06 rifle than having someone attack me in public, but I already have put a lot of money towards my conceal carry permit and jacket. Which firearm do you think I should go for first? I have it down to both of these because they are in my price range and like them both, and have their own special purposes. Thanks for helping me with this decision.

			<content:encoded><![CDATA[<p>I&#8217;m away from home right now, but when I get back I plan on getting a pistol. I&#8217;m not too knowledgeable on the subject of firearms (other than the ones I&#8217;ve had experience with, most of which I don&#8217;t believe you can own legally). Right now the only gun I own is an oooold 22 that has been in my family for almost a century.</p>
<p>The [2] main qualities that I am looking for are: easily concealable and low recoil</p>
<p>Reason being that I also plan on getting a concealed carrier license, as well as something that won&#8217;t knock my wife on her backside when/if she has to use it.</p>
<p>Thanks in advance.<br />
Shooter &#8211; Looks pretty good. One of the guys here with me has a Springfield 45. He swears by it. Any other ideas just for the sake of looking.</p>

I&#8217;m in the military, so the weapons I have most experience with are 240Bs, 249s, 50 cal, that sort of thing&#8230; Not the most practical weapons for self defense (stateside anyway) although it might be fun.<br />
That fn five seven looks like a little beast (and you&#8217;re right, the rounds do look like baby 5.56s) However, although it&#8217;s not out of my price range, I&#8217;ve told myself that I don&#8217;t want to spend more than 6 or 7 hundred.

<p>Brewer signed the law saying local police can now question people who have possibly committed a crime their legal status and jail illegals.</p>
<p>None of this would have happened if Obama didn&#8217;t selecte the lesbian Napolitano to head the DHS.  She&#8217;s made a mess of things in DC embarassing Obama and has allowed Arizona to become much more conservative.

			<content:encoded><![CDATA[<p>Ok, the issue in question is in regards to the legal carrying of concealed weapons.  I possess a valid concealed weapons license issued by the state BCI.  My concern is with an ordinance that is in effect for the city in which I live.  The ordinance states that: &quot;No person shall knowingly possess a firearm on his person or shall possess a firearm within his control on private property without the consent of the owner of the property or the person in charge thereof.&quot; </p>
<p>The problem is that there is a specific provision in state century code that states: &quot;62.1-01-03. Limitation on authority of political subdivision regarding firearms.  No political subdivision, including home rule cities or counties, may enact any ordinance relating to the purchase, sale, ownership, transfer of ownership, registration, or licensure of firearms and ammunition which is more restrictive than state law.  All such ordinances are void.&quot;</p>
<p>Further, the state defines the locations where carrying of a concealed weapon is prohibited, these sites being: &quot;Liquor establishments, gaming sites, any public gathering, including: sporting events, schools or school functions, churches or church functions, political rallies or functions, musical concerts, publicly owned or operated buildings, and publicly owned parks where hunting is not allowed&quot;.</p>
<p>I&#8217;m wondering what the first point of procedure should be, or who I should contact regarding the validity of this city ordinance.  Should I contact a private lawyer, court system, etc?  Thanks for your help.<br />
In response to Elwood.</p>
<p>The conflict is within the &quot;Licensure&quot; as mentioned in the state century code.  The state has issued me a license in which I may carry a concealed weapon in all locations not provisioned against/prohibited by the state.  If &quot;Licensure&quot; wasn&#8217;t specifically noted in the code, I would agree with you completely.<br />
An additional note.</p>
<p>The city ordinance I mentioned is sub section B of a parent section.  Section A states: (a)   No person shall knowingly possess a sidearm on his person or shall possess a sidearm within his control on private property unless:&quot;  Sub-section A.(1) &quot;He is allowed to do so under a permit issued pursuant to state law;&quot;</p>
<p>That&#8217;s where I&#8217;m being confused.

<p>Example, the felony ban on taking a firearm within 1,000 yards of a school.  If you take a protractor and draw a 1,000 yard radius around each school on a map, you will find the circles overlapping and virtually shutting off all major throughfares in a city to those who would harmlessly transport their firearms to a range or from a store to their homes.</p>
<p>Filling out a form incorrectly when purchasing a firearms.  If you botch the address (put St. instead of Street, for example), technically the feds can charge you with a felony offense.</p>
<p>Exposing a concealed weapon inadvetently.  If you have CHL (Concealed Handgun License) in a state and the wind blows your overgarment up to reveal the grib of your sidearm, you are guilty of a crime.  (Would not a minor fine be more appropriate?)</p>
<p>If some angry girlfriend issues a protective warrant against you, you are suddenly a felon for being in possession of a firearm, even though you were not present in the proceedings to argue your case, not givin any opportunity to transfer your firearms out of your possession.  (Are we not innocent until proven guilty?  Should not only guilty parties be denied their freedoms?)</p>
<p>Domestic Gun Ban.  If you were ever convicted of a &quot;misdemeanor&quot; offense of family violence, you incur a &quot;lifetime&quot; ban from owning firearms, and if any are in your custody at the time of the conviction, you are automatically considered a felon.  (Since when did misdemeanor offenses eliminate one of the freedoms in the Bill of Rights?  Would banning someone from voting for getting into a misdemeanor scuffle from a political argument be tantamount to the same?  Is not the Democrats&#8217; move to grant prior felons the right to vote a contrast to denying those with misdemeanor offense the right to self defense?).</p>
<p>We are incrementally losing our freedoms to legislators who continue to grow their own power.</p>
<p>I say gun control is more about population control than fighting crime.</p>

No, the suggestion to join the NRA is not wise.  The NRA has collaborated too many times with the anti-Gun folks in Congress.  Maybe joining the GOA (Gunowners of America) works.<br />
Anti-Gun crowd:  wants more gun restrictions.<br />
NRA:  wants stiffer penalties for gun violations.</p>
<p>Both effectively advance the cause of Gun Control.

<p>Seattle Mayor Greg Nickels, in a sweeping attempt to respond to a rarely occurring problem, has issued an executive order banning firearms from all Seattle city facilities, including parks, Seattle Center, and community centers. The order includes holders of concealed pistol licenses (CPLs).</p>
<p>Mayor Nickels apparently has a reading comprehension problem. The statute, RCW 9.41.300, is clear as can be:</p>
<p>(2) Cities, towns, counties, and other municipalities may enact laws and ordinances:</p>
<p>. . .</p>
<p>(b) Restricting the possession of firearms in any stadium or convention center, operated by a city, town, county, or other municipality, except that such restrictions shall not apply to:</p>
<p>(i) Any pistol in the possession of a person licensed under RCW 9.41.070 or exempt from the licensing requirement by RCW 9.41.060; or</p>
<p>That last part, refering to 9.41.070, is the concealed pistol license section.</p>
<p>But the Mayor thinks that his reading of a confused decision by Justice Fairhurst overrides plain language. I guess I should not be too surprised: in our postmodern world words can only mean what nobody thinks they mean.</p>
<p>So how would something like this hold up in court?

<p>In a nutshell, the places that are restricted are court facilities (although they must provide the citizen with a lock box, or individual that will store your weapon), liquor establishments that are off limits to those under 21, school facilities (with certain exceptions), law enforcement facilities, and places where inmates are housed.</p>
<p>There is also a law that allows cities and counties the ability to restrict firearms in stadiums and convention centers, but strictly exempts those who possess a Concealed Pistol License &#8211; although you do not *have* to conceal it. You can carry it openly or concealed.</p>
<p>This brings me to my question,</p>
<p>One city in particular has created a specific ordinance that restricts the carry of firearms in their city park. It&#8217;s listed on their municipal code, and this ordinance is not in compliance with state law.</p>
